EU Representation
The representatives Mail Tactic Corporation has appointed in the European Union, under the GDPR and under the Digital Services Act, and how to reach them.

Mail Tactic Corporation, which operates mailkube, is incorporated in Delaware and has no establishment in the European Union. Two separate pieces of Union law require a company in that position to appoint someone inside the Union who can be addressed on its behalf. Both appointments are set out here, in one place, so that our other legal documents can point to this page rather than repeat the details.
Each role is held by a different company in the Prighter group, both established in Vienna.
Representative under Article 27 GDPR
Mail Tactic Corporation has appointed the following representative in the European Union pursuant to Article 27 of Regulation (EU) 2016/679 (GDPR):
Prighter EU Rep GmbH, Schellinggasse 3/10, 1010 Vienna, Austria.
The representative is the point of contact for data subjects and for supervisory authorities on all issues related to the processing of personal data.
Under Article 27(4) GDPR, the representative is mandated to be addressed in addition to or instead of Mail Tactic Corporation. Which of the two you write to is your choice, and writing to the representative is not a lesser route.

Any of the three reaches it. Mail Tactic Corporation remains directly reachable at privacy@mailkube.com.
Legal representative under Article 13 of the Digital Services Act
Mail Tactic Corporation has appointed a legal representative in the Union pursuant to Article 13 of Regulation (EU) 2022/2065, the Digital Services Act.
Article 13(4) requires four particulars to be published and kept up to date:

Under Article 13(2), the legal representative is mandated to be addressed in addition to or instead of Mail Tactic Corporation by the competent authorities of the Member States, by the European Commission, and by the European Board for Digital Services, on issues necessary for the receipt of, compliance with, and enforcement of decisions taken under that Regulation.
What these appointments do not do
Under Article 13(5) of the Digital Services Act, designating a legal representative in the Union does not constitute an establishment in the Union.
Neither appointment limits what may be done against Mail Tactic Corporation itself. Article 27(5) GDPR provides that the designation of a representative is without prejudice to legal actions that could be initiated against the controller or processor. Article 13(3) of the Digital Services Act provides that the legal representative may be held liable for non-compliance with that Regulation, without prejudice to the liability of, and the legal actions that could be initiated against, the provider of the service.
